Lawyer Fay Brunning Accuses Mayor Bob Kilger of CONFLICT OF INTEREST & Making Mockery of the Law!

Bobhappy1-800x422CFN – Lawyer Fay Brunning released a stunning email this morning suggesting that the Cornwall’s Mayor’s conduct is illegal and that he in fact has not been cleared as his lawyer RULED of any issue at this point.

Below is Ms Brunning’s email to media unedited.

You have asked me for my comment about the Mayor’s news release of March 5th.  My comment is that his conduct is illegal and his news release makes a mockery of our democratic and legal systems.  No one is above the law and City Council should enforce the law against the Mayor.

In January 2013, the Divisional Court of Ontario ruled that $3,100 was not too small of an amount to invoke of the Municipal Conflict of Interest Act.  Under the MCIA, any member of Council with a pecuniary interest must declare it and may not participate in any meetings nor influence any other member of Council on matters touching the conflict.   The pecuniary interest of Mayor Kilger in question is in excess of $100,000, for the purpose of application of the MCIA, arising from the whistleblower complaint of one of the internal managers.  Since no later than May 31, 2012, Mayor Kilger has been in a conflict of interest under the MCIA, but it has been totally undeclared to the public.  The Mayor and/or Council have not obtained a court ruling on this issue.

Electors of Cornwall are the persons who have the right to invoke the protections of the MCIA.  Until there is a declaration of the Mayor’s conflict of interest, recorded in public minutes of Council, the electors’ rights continue to be violated.   The electors are the beneficial owners of the municipal corporation.  The reason for the MCIA is that every council member must step aside if he/she have a pecuniary interest, because councillors must govern only in the best interests of the electors and may not be influenced by their own pecuniary interests.  Councillors are supposed to conduct the business of Council in a transparent and accountable fashion under the Municipal Act.  The exceptions are limited and ARE NOT MANDATORY.

My client filed his complaint directly to each member of Council on May 31, 2012, and he asked for an external, qualified investigator be appointed to get to the truth behind the allegations, because some of them put the Mayor in a conflict of interest.  Instead, a subordinate person within the City was appointed to investigate his superior and the allegations pertaining to the Mayor.   After the court rulings in Magder v. Ford in Toronto, since early December 2012, I have repeatedly asked for the provisions of the MCIA to be enforced for the public, by the remaining members of Council.  I have asked that the Mayor be excluded from all participation and not be allowed to influence other members of Council.   We had to threaten legal proceedings.  More lawyers were brought in.   Finally, the matter was to be discussed with City Council on February 19th

In advance of the closed meeting on February 19th, the agenda stated that the Mayor would chair the closed meeting.  My clients and I protested.   On that day, immediately prior to the closed meeting, two of the lawyers reportedly met with the Mayor and the Mayor left the building.  The meeting on the 19th proceeded, without the Mayor, entirely behind closed doors.   Ask Council if the Mayor was directed to not attend because he was in a conflict under MCIA.      

 

Section 6(2) MCIA makes it mandatory that even for closed meetings of Council, at the next open meeting (February 25th), the declaration of interest must be made by the member and recorded in the minutes by the Clerk.

 

Although the next open council meeting (February 25th) was not available for viewing on Cogeco, the minutes of the Clerk do not record any declaration of interest by the Mayor on the 25th.    The Mayor did not declare any conflict of interest. 

 

If the Mayor is conducting himself in an illegal fashion under the MCIA, why is the rest of Council allowing that to happen?    Illegal conduct should not be permitted by the rest of Council and the Mayor should have had to declare his interest, or to have his position contested in open Council.

 

The Mayor’s press release is not a declaration of interest under the MCIA.  The declaration must be made in an open session of Council.  The Mayor’s news release about his lawyer’s opinion is not binding on the rest of Council.  One would expect there to be debate on this issue in open Council if the Mayor announces he was not in a conflict and he tries to rely upon his own lawyer’s opinion.  In the absence of a Court ruling, his lawyer’s opinion is not binding on Council.   Council can decide if the MCIA puts the Mayor in a conflict of interest on the whistleblower complaints. 

 

Alternatively, City Council could publish the legal opinion of the City Solicitor that the MCIA does not apply to the Mayor so that the public (including  lawyers in Cornwall) can review whether that legal opinion is valid.   The recent decisions of the Court regarding Mayor Ford in Toronto clearly support that Mayor Kilger must declare a conflict under MCIA and that he should not have been involved in any of these whistleblower matters since May 31, 2012.   Members of the public could be allowed to see the legal opinion that bears upon whether their rights are being protected by the City Solicitor.  City Council itself decides whether or not to waive solicitor and client privilege, not the lawyers. 

 

This declaration of interest under MCIA, to be recorded in Council Minutes, is very important because as of that day, Cornwall electors have 6 weeks to bring an application to the Court  to remove the Mayor from office for violation of the MCIA.  The Mayor and other Council members cannot stop electors from directly seeking that remedy.  Electors have the direct power to remove the Mayor from office for violation of MCIA.

Not only can the Mayor be removed, but under the MCIA, each decision of Council in which the Mayor wrongfully participated and/or influenced other members of Council, is subject to being set aside.  That would include the deal the Mayor made with Mr. Fitzpatrick around June 29, 2012.   That would include the lack of powers/protocol granted to investigators to get to the truth of the whistleblower allegations. 

 

Whistleblowers are not to be blamed for causing legal costs.  Whistleblowers are trying to ensure the law is followed, despite the huge risks they take to reveal misconduct to the proper authority.  Right now the proper authority is City Council.   City Council has to get to the truth and to follow the law.  Remember the outcome of the Cornwall Inquiry, which condemned the secret deals, improper discipline of whistleblower complaints and abuse of authority?    Remember the City’s criminal conviction in October 2011 for illegal retaliation for reporting resident abuse at the Lodge?   Council was investigating that illegal retaliation when these two whistleblower complaints were provided to Council members.  Remember that one Councillor resigned in protest?  Remember that one Councillor won his complaint to the ombudsman for being berated in a closed meeting by the Mayor for doing a video to the public that was posted on CFN?    

 

The Citizens of Cornwall could ask every individual member of Council to publicly record in Council whether he/she believes the Mayor is in a conflict of interest under the MCIA and to state they are committed to ensure the law is being obeyed.   How can witnesses be expected to come forward with their information in these whistleblower investigations if City Council cannot be counted upon to abide by and to enforce the law, regardless who is under investigation?   Does Cornwall really need another public inquiry?  Not if Council follows the law and investigates properly to get to the truth.

 

City Council could declare the Mayor to be in conflict.  Why transfer responsibility to the whistleblowers and why put their personal assets at risk to have to go to a Court of law to enforce the law?  City Council could force the Mayor to bear the risk and liability of starting legal proceedings to prove his is not in a conflict.  If remaining members of City Council do not follow the MCIA, they will become respondents and part of the Mayor’s conflict in subsequent legal proceedings.  

 

This is currently a game of hide and seek because the Mayor will not declare his conflict in open Council, and the trigger date for 6 weeks to remove the Mayor has not commenced.  The media is being treated like the enemy when they are seeking answers on behalf of the public.   Members of the public who attend and protest are being harassed and intimidated.  The course of conduct to date makes a mockery of our legal and democratic system.   The law is clear and should be followed.  No one is supposed to be above the law in Canada.  This democratically elected government surely should follow the law without a Court or public inquiry telling it to do so.

 

Taxpayers’ monies is being wasted on all these legal proceedings.  Why disobey a clear law which exists to protect the public?  Taxpayers’ monies may also be wasted/not recovered if the investigations are not sufficiently powered and/or independent of the accused persons, to get to the truth.     The public is not being sufficiently protected/represented in this legal dispute.  Electors can activate their democratic powers by contacting Council members directly and asking that the law be followed and the truth be properly investigated.  Or the public can band together and hire one of your excellent lawyers in Cornwall to represent the public under MCIA. 

 

Complacency of the public is the biggest threat to our Canadian democracy.

  1. So he also contravened the MCIA by not disclosing his previous in camera exit due to a conflict, when he failed to disclose it at the next open meeting. Wow! Maybe the t-shirt threw him off. His lawyers are digging his political grave for him. Will he take his humonculous fireman with him when he leaves? Maybe apologize to his wife and the citizens?

  3. So we now have a battle of differing lawyer’s opinions. I guess it will be up to a real Judge to rule on this at the expense of Cornwall taxpayers.

    Kind of makes the SF attempt at covering up the Mayor’s dirty deeds look pretty lame doesn’t it. I thought reporters were supposed to investigate or at least authenticate information that is handed to them.

The remaining media are looking pretty gutless. Problem is there are too many people happy to eat the spoonful of sugar they’re being fed.     As I mentioned in the previous story about the same topic, Bob doesn’t attend meetings so he is no longer in conflict of interest. He is not innocent merely hiding from future allegations. He is lying and using his lawyers in the charade.

    It is back room politics, what ever discussion occur in the confines of the Best Western basement lounge are what we see tabled in council meetings.

    Now we see stall tactics until they can all fabricate a story that matches, doctor documents and create a false trail.

    Only then will we see a Inquiry. But like project truth it will be so hidden it will be hard to find

  9. Well this article surely made my day. Thank you Jamie and thank you Fay Brunning. It is about time that someone like Jamie and the “whistleblowers” and others who paid a terrible price like Andé Rivette and Leslie O’Shaunessey have gone through and still going through.

    If things were done in a proper way in past years then the guilty would be tried in the right way instead of a “conflict of interest” and everything swept under the carpet. These “rich scum” have to be exposed and the sooner the mayor leaves the better things will be. The mayor is not allowed to influence council in any way but this bully sure has done a great deal of harm since he has been in. Too many people go into council and mayor not knowing the laws. Someone said that the mayor is a high school dropout well that does not look good to be the senior one and not have a basic education. All he knows or did know is how to chase a hockey puck down the ice and anybody can do that.

    I sincerely believe that Kilger should be removed and all council who isn’t up for the job should go. Only André Rivette, and Maurice Dupelle should remain. I think that Mr. Leslie O’Shaunessey should have his job back and that Mr. Mark MacDonald should be mayor. Again this made my day for a starter. Nobody is above the law no matter who they are.   10. SF “CORNWALL’S {MODERATED} makes absolutely no sense at all and I have quoted many times what its uses are and it sure isn’t for any news. Forget that dirty rag and keep your money in your pocket because you are all going to need it soon enough.

    Jamie is the man in Cornwall telling you the truth and the others are all in a conflict of interest and only there to show Kilger’s mug shots while cutting ribbons and what not. The same goes for the other show offs in town. I refuse to open SF’s toilet paper of record on my computer or any other way.

  13. seems a lot of people are saying these are lawyers opinions. that may be true but it appears to me you have facts from Ms. Brunning and tactics by Kilger’s lawyer. Remedying the situation is dependant on the actions that need by taken by Council or the public. If those recommendations are ignored, Kilger’s tactics team could win and Ms. Brunning could lose. Action needs be taken ASAP.

    Yes, the same way that Mayor Kilger voted on GSDL where his own mother resides and council reversed their decision after CFN broke the story Soc. If good people stand up; bad people have to stand down.

  15. Question: if the clerk’s minutes do not reflect a statement of conflict made by the mayor on the 25th/Feb, and he is indeed in conflict, Council’s got him. What’s holding them back?

  16. It will be interesting to see if any of the councilors come forward to clear their names of complicity in light of Fay Brunnings’ assertions.

    I would think the time to put some distance between themselves and the situation about to unfold might be better done sooner rather than later.

    I can’t speak to that Smith as I’m not an expert. As a taxpayer though and voter I certainly have concerns about someone that is a councilor and wants gigs like being our MP or MPP, or judge who has behaved as Bernie Boo Boo has.

  27. As a former masseuse to the Maple Leafs I think I can speak from the view point of a person that has been associated with professionalism and extreme business acumen.

    Mayor Kilger is trying to diffuse the situation with smoke and mirrors. Some media outlets print that the mayor is “cleared” by his lawyers. What the other media fails to mention is that his lawyers don’t clear anyone, they merely offer an opinion. Fay Brunning points this out clearly, and also points out why the Mayor is in conflict and the impact that may have on other members of council.

    What the members of council don’t seem to understand is their obligation to adhere to the law, to the obligation of their constituents, to moral code and to what is fair and just. This isn’t some scandal where an individual is caught having relations with a masseuse and traded to another team in Florida…this is the real world. Let’s hope that council won’t be bad team mates and ask for the immediate benching of the Mayor, the son should never have been let off the hook with a trade, why allow the father.

  29. Looks like a conflict of interest among lawyers battling it out in the media.

    The place for this is in a court of law.

    The city is probably headed for bankruptcy simply from all the litigation, wrongful treatments of whistle-blowers on top off with holding requirements under the laws to protect the citizens against fraudulent bullying and weak kneed challenging by council of higher powers.

    No wonder their is no money for charities and other great causes and the tax assessments are far too high in this town relative to other similar communities and plain common sense.

    This all happened about the time they were grooming him for his term as a local MP.

  35. Impeach him now. That is the single best solution before we hear even more bullying tactics.

    After councilors take their month at a time duties as acting mayor until the next election we need to exercise prudence and caution on how our next mayor is vested by the voters.

    First and foremost, he/she must be a mayor of the people as shown by grass roots, work from the bottom up, live within our city boundaries mayor.

    Mayor Kilgor WAS a populous mayor, no question. Why, he had so much history, we were blown away with the possibilities of parliamentary connections, a triple A hockey team returning to Cornwall, industry rolling in. You name it, it was thought that HE was the man. Well, by some of us anyway, obviously enough to believe in him that he was voted in, not once but twice.

    How duped we were!

    Why, oh why did things go so wrong?

    May I suggest that a main reason could well be that Mr. Mayor was so filled with former POWER it was difficult for him to come down to earth from the halls of parliament to the floors of a lowly city hall, having to buck up to even lower on the planet backwoods councilor compared to MP’s who respected him.

    May I further suggest that from now on we look into the mirror, work with those who are going up the ladder, rather than coming down.

    We do in fact have one or two such persons on council now. One (man) in particular that I was impressed with after just one initial brief meeting. For now I will leave those thoughts with you so you may be sure to review to take care about painting all of council with the same brush……..they are different.

    For sure, other aspiring young men and women of our community who are strong minded and quite capable will be waiting in the wings. NOW IS THE TIME TO MAKE YOUR OVERTURES KNOWN.

    Note too, as a reminder, that this is a city council, not necessarily a road to provincial or federal politics, however a point at which communication skills would allow smooth discussions and work with any and all party affiliates. A non-partisan or certainly a person able to ‘bury’ his affiliations for the most part in order to hold a mayoralty office. YES, bilingualism would be an asset,not s requirement, as the voters decide.

    Perhaps a few premature comments, yet it won’t be that long before the next election is revisited…..but can we please IMPEACH THIS ONE BEFORE HE COSTS US AND EMBARRASS’S AND MOCKS US ANYMORE?

  36. Hayley Brown I saw that about Kilger on the net and I bookmarked it. Hayley you have to have confidence that something can be done to get rid of Kilger and all those who are like him. If we do not do anything then the stink will keep on going without any end. We have to go after the guilty and believe me they all stink to high heaven.

    In London Ontario they got hold of Fontana and in other places they get them all as well. Kilger is not above the law – he only thinks he is and about time to wipe that smug on his face and send him packing. I don’t care if he were the wealthiest person on earth – I would rather see those dirt bags hang.

It is time that the residents of Cornwall; only elect new blood and accredited honest people. This crap has been ongoing and people have had their heads in the sand. When election is getting closer we need to revisit all the blown tax dollars for pay-offs, early retirements, golden handshakes.

    Now to see that so many behind door issues affect our lively- hood, and that of our families. I challenge all readers to be there when election time gets closer; and pay attention and bring forward all the issues that were not dealt with properly before more crap is given under the quise of doing what is best for our city.
    I for one am sick and tired of raising taxes and not being heard or validated. Small business’ have to stand up now and be counted. The English speaking of this city need to stand up and be heard loud and clear. Let your X stand for an honest City Council. Seeing that no Alderperson left any of those behind the door meetings speaks volumes.

  45. Duckers Kilger cannot be forgiven. If you only knew what this man did your hair would curl. Kilger and his “clique” all over Cornwall “Tombstone” and beyond must be eliminated and sent on the rails.

    I just had a brainstorm of some sort and that is for everyone to not purchase the SF “Cornwall’s toilet paper of record” and with the money that you spend on that rag – support Jamie instead.

    I read something under the column about the former CGH that someone mentioned that Terry Landon was being groomed for mayor – OH GOD NO, GOD FORBID that would be a terrible mistake. He is part of the problem. I have that one bookmarked as well.

    I see Cornwall going bankrupt in the near future and I said that before here on CFN and I wasn’t kidding – I am mighty serious. Just keep up these crazy, insane antics and nobody can save any of you not even Jamie. Jamie is working mighty hard and all of you don’t know how hard. I truly feel that it is about time that Cornwallites come out of the sand and out of “Sleepy Hollow” and really know what is going on.

    Kilger is the worst mayor that I have ever known in my 62 years. This clique goes beyond Kilger and you have to look at the whole gang and they all must go. They have destroyed a very good man Perry Dunlop. The whole BARNEY FIFE PD must go as well especially at the top levels. Yes the top levels are mighty corrupt. Open your eyes and think about Project Truth because everything in that was the truth and I know a great deal more that was not on there. Only all of you can do that – I can’t because I am an Ottawa resident. I left for mighty good reasons and will not go back dead or alive and my family knows that. Kilger really is something else and he must be taken out now not tomorrow but now. If you don’t all smarten up you will pay the price.

    Detroit Michigan used to be a city of over 2 million people. Now the place is pretty well deserted at less than the population of Ottawa. Obama wants to bulldoze 1/3 of Detroit. What do you all think about what Cornwall is going to be like when you see Detroit in such a condition. Detroit was #1 in manufacturing and it was #1 in the car industry and now look at it today. I want people to open their eyes wide.

    The same holds true with other American cities – the infrastructure is in a total disaray and the NYC subway is like Calcutta. The Chinese are using the useless US dollars to build up their infrastructure.

    Do you all know what I heard is that Singapore in Malaysia might be the new NYC of finance since the US is at bankruptcy state. I have been warning all of you for a long time now to learn the old life skills because you are going to need them to survive. The west is dying a slow death and the east will rise unless people in the west change. Things are not looking good and people have to wake up now not later but now and this is the truth and mighty crucial.

    Jamie is top notch but I can tell you that this great man can only do so much and it takes an intelligent people to make a difference and not just one person.
