Cornwall To Go To Trial Over Seniors Abba Noise Citation by Jamie Gilcig OCT 27, 2016

CORNWALL ONTARIO – Cornwall By Law Officer Larson Payette is a busy boy.   He is involved in the false vicious dog citation given to a city man which appears to be heading towards the same courts as the case of Doug & Rachelle Raymond  who have engaged local lawyer Andre Bourgon instead of simply paying a $130 noise citation that they feel they clearly did not deserve.

At a first appearance the City’s high priced non local lawyers from BLG appeared.    Cornwall CAO  Maureen Adams did not respond to a request from CFN as to the city’s legal bill to date, but several legal beagles cited estimates of $3,000 to $5,000 and counting, while estimates of the Raymond’s legal bill could be as much as $2,500.

Which is why Mr. Raymond was utterly flabbergasted when a knock on their door Tuesday led to a citation of $130 which was delivered by a Cornwall by law enforcement officer who had decided to accept the complaint of a neighbor without proof or speaking to the Raymond’s.

This is the same by law officer that gave a “Vicious Dog” order over a month ago in the same manner, that the city has yet to respond to.

Mr. Raymond, speaking with this writer, stated that their neighbor has phoned police over fifty times making complaints and that they’ve never been warned or charged, including previous noise complaints.  He was so upset he contacted Cornwall Power Lawyer and former Crown Andre Bourgon who had defended the Worm Kids.

 

This begs the question of what the heck is going on under By Law poobah Chris Rogers, and eventually CAO Maureen Adams?

Ms Adams recently floated a pork chop about what the Diane Shay case cost tax payers.

Clearly due process has not occurred in these recent cases which begs the question as to why the city would pursue them at such high cost?  Is this justice served and what message does it send to the public, because many can’t afford legal support to fight such injustices.

Does it make sense for anyone to be fined without any proof or a by law officer or police officer witnessing the offence as has happened in both this situation and the vicious dog citation?

My wife & I with our lawyer Andre Bourgon attended a pre-trial today regarding the fine($130) my wife Rachelle received on Aug 2/16 from the City’s by-law officers for excessive noise with our sound system on July 29/16.
As my wife is innocent of the charge our lawyer advised that we go to trial. The City’s lawyer agreed and the trial date is set for March 1, 2017.
This indicates how wasteful the City administration is by spending thousand of dollars of taxpayers money  on legal fees in trying to recoup $130.
I  also hope this is an eye opener for city councillors to react on this issue.

Mr. Bourgon clarified that this was in fact a simple first appearance at POA Court where provincial offences are dealt with.

Clearly something needs to happen with the by law office in Cornwall as complaints build up.  This newspaper is currently investigating seven other complaints from the public (info@cornwallfreenews.com if you have a complaint)   Many eateries complained of abusive food inspections as well.   Each one of these stories that come to light only hurt the community at multiple levels.

With Cornwall finishing again at the bottom ranks of the CFIB Canadian Entrepreneurial rankings something needs to be reviewed, and if needed fixed.

Likewise, for a community bent on attracting seniors how does a case like this citing Seniors playing cards help?

After all the CBC picked up our original story and it went national on As it Happens.  Is this what we want our city known for?

  1. This makes no sense. Spending $3000 to $5000 of city money and $2500 on the Raymond’s money to figure out a possible $130 fine. But this is Cornwall….so this is not unexpected. The bean counters have lost their beans.

  4. I applaud the efforts to stand up and defend a matter of principle despite potential costs. At the end of the day the City of Cornwall (taxpayers) is likely to foot the entire legal bill (all parties). What time of day did this horrendous offense occur? What was the dB level measured by the claimant/by-law officer? In Ottawa the acceptable dB level outside I believe is a maximum reading of 60 dB’s

  5. The by-law department does seem to have it challenges of late. For example the 6″ grass by-law is unenforceable according to a senior City of Cornwall official. So why does it remain on the books? My challenge to this by-law is likely to cost the City of Cornwall as much or more than this challenge to a noise citation.     Feel to email me at info@cornwallfreenews.com The only way to improve things here in Cornwall is to expose what is wrong and hopefully make changes to avoid it from happening again even if that means some people get reassigned or lose their positions. We need to clean house from top to bottom.

  7. Hugger1..remove cognitive skills, common sense and simple math from the City of Cornwall’s side of the equation and it all suddenly makes a great deal of sense. Just not the kind of good sense that we need to properly administer the needs of Cornwall’s residents and taxpayers. Perhaps we need a movement to make Cornwall great again. Next election could be a bared knuckle free-for-all. One can hope

    You mean like a food inspector leaving a commercial fridge open for 20 minutes and then doing a temp check and causing the restaurant to pay for an emergency service call for nothing?

  11. Well thank you Jamie I figured that my common sense would catch on. I played the ABBA song and love their music and how about I join the couple and dance away the night and day with good music like that.

  12. Jamie when we lived in an apartment in the north end the manager of the buildings had their relative (a youth) play on a skateboard day and night literally that drove us all nuts and nothing was ever done. Something is very wrong in Cornhole that is for sure.

  13. This is very difficult when people own homes and some neighbors disrupt others or a hate against certain people. Gee Jules stay in rent for God sake you’ve got it made. Yes I know that after what we have experienced. I won’t make that mistake again.

  17. I too, fell for the anybody but BOB campaign (sorry Jamie) , but as both of you stated , what a mistake on my part ! However,,, I’ll fight to make amends ? lol I’m absolutely disgusted by our Council & all of our high paid, “out of town’ Managers & Dept. Heads. What a terrible example, when most , if, not all of our Senior Management, live out of town ? CLEAN HOUSE !

  19. This morning when my husband and I came back from our walk and went into the car what song came on the car radio but ABBA and I was in my glory and singing along with the radio and thinking about what happened in Cornhole. LOL LOL. I should have stepped out for a dance.

  20. What the sheeple of Cornhole are going to have to do is to examine their conscience when they vote. Jamie would make an excellent mayor and there is one more person Denis Sabourin who is well educated and the only downfall is that he is part of the clique which is very bad otherwise this man has all he credentials. I would vote for Jamie if I were in Cornhole.

  21. Cornhole has way too many incompetents in its town hall and I am not talking about people who choose to live out of town because that is their choice – it would be mine as well. A mighty incompetent mayor, a mighty incompetent council and a mighty incompetent administration. There are a mighty few exceptions but that is mighty rare.

  23. E.T. Bass it should read Lez not forget what Lying Lez put Diane Shay through along with some others. Lying Lez should be very ashamed of himself and do the town a favor and resign. This chicken came out with lies from the beginning when he was in BOB’s administration and fooled up all. You cannot fool us anymore Lying Lez.

I remember all too well what the Vincent family went through the came the Cadieux family who did nothing wrong and people pulled a Gladys Cravits from Bewitched and spied on them and turned their lives upside down and then Diane Shay and the hell that she went through among others. This is really nuts to the core.
