Illegal Tobacco Busts and Police Blotter for Cornwall Ontario and Area – December 16, 2010

Cornwall ON –

The Cornwall Regional Task Force (CRTF) made several contraband tobacco seizures in the following regions between November 25th and December 07th2010:

  • Two (2) seizures in Cornwall, Ontario
  • Five (5) seizures in South Glengarry, Ontario
  • Two (2) seizures in South Stormont, Ontario

These seizures resulted in the arrest of the following five (5) individuals who are charged under the federal Excise Act 2001 and who also face charges under the provincial Tobacco Tax Act for possession of a tobacco product not properly stamped:

Shaine Robertson (age 23) of Cornwall, Ontario; also charged under the Criminal Code for failing to comply with a condition of an undertaking given to an officer in charge;

Cimon Arsenault (age 29) from Quebec, Quebec;

James Cholette (age 28) of Cornwall, Ontario;

Darcy Finner (age 46) of Cornwall, Ontario;

Joshua Paul Tilley (age 18) of Cornwall, Ontario,

ALSO, these seizures resulted in the arrest of one (1) other individual from Hamilton, Ontario who will be charged under the federal Excise Act 2001 and/or the provincial Tobacco Tax Act for possession of a tobacco product not properly stamped and for possession of cannabis (marihuana) under the Controlled Drugs and Substances Act.

Items Seized:

• Six (6) vehicles described as follows: a 2004 Ford Pick-up; a 1994 Mercury Marquis; a 2002 Ford Windstar; a 1993 Chrysler Intrepid; a 2002 Pontiac Montana and an ATV Yamaha Raptor;

• Two (2) trailers described as a 2001 Cargo Express Trailer and a Bush Buggy ATV trailer;
• One (1) vessel described as a Wareagle boat with a 115 HP Evinrude outboard motor;                    • 7,073 re-sealable baggies and cartons each containing approximately 200 contraband cigarettes.

ASSAULT

Cornwall, Ont. – A 22 year-old Cornwall female was arrested on December 14th, 2010 following a domestic disturbance investigation.  It is alleged that on the previous date, she attended her ex-boyfriend’s residence and an argument erupted.  During the argument, it is alleged that she slapped her 23 year-old ex-boyfriend across the face.  The male did not require medical attention at the time to the incident.  Police were contacted and as a result of the investigation, the female is facing 1 count of Assault.  She was released to appear in court on the 18th of January, 2011 to answer to the charge.  Her name is not being released as it may identify the victim in this incident.

BREACH OF CONDITIONAL SENTENCE ORDER AND PROBATION and TAKE MOTOR VEHICLE WITHOUT CONSENT

Cornwall, Ont. – A 28 year-old Cornwall female was arrested on the 15th of December, 2010 for taking a motor vehicle without consent.  The female was bound by a Conditional Sentence Order with a full house arrest condition and also bound by a Probation Order with a condition to Keep the Peace and be of Good Behaviour.  It is alleged that in the early hours of the offence date, the female left her residence and took a motor vehicle without the owners’ consent.  Police were contacted and she was arrested for 1 count of Take Motor Vehicle without consent, 1 count of Breach of Probation and Breach of her Conditional Sentence Order.  She was held in custody until court the following day.  Her name is not being released as it may identify the victim in this incident.

ASSAULT, BREAK AND ENTER and POSSESSION OF STOLEN PROPERTY

Cornwall, Ont. – A 34 year-old male of No Fixed Address was arrested on the 13th of December, 2010 following two investigations which began in August 2010.  It is alleged that on August 12th, he broke into a room at a Vincent Massey Drive hotel and stole property.  It is further alleged that on August 16th, he assaulted a family member.  The victim did not require medical attention at the time of the incident.  Police were contacted on both cases and investigations began. The investigations resulted in the male being arrested for 1 count of Assault, 1 count of Break and Enter and 1 count of Possession of Stolen Property.  He was held in custody until court the following day.  His name is not being released as it may identify the victim in one of the incidents.

BREAK AND ENTER

Cornwall, Ont. – The Cornwall Community Police Service is investigating a break and enter which occurred on December 14th, 2010 between the hours of 12:00 and 1:00 p.m. at a McConnell Avenue apartment.  The suspect(s) gained entry through a front door window.  Once inside, the suspect(s) stole money.  If you have any information regarding this break and enter, please contact the Service by dialing (613) 932-2110.

WARRANTS

Cornwall, Ont. – Nigel Andrew Kyte, 23, of Cornwall was arrested on December 13th, 2010 on the strength of two outstanding warrants.  He was bound by an Undertaking Order with a condition to Keep the Peace and be of Good Behaviour.  It is alleged that he failed to attend for his scheduled fingerprint appointment on the 24th of November, 2010 and further failed to attend court on the 30th of November, 2010.  Two arrest warrants were in force.  He was held in custody until court later that day.

THEFT and BREACH OF PROBATION

Cornwall, Ont. – Anthony Joseph Kevin Nuttall, 32, of No Fixed Address, was arrested following a theft investigation.  The male was bound by a Probation Order with a condition to Keep the Peace and be of Good Behaviour.  On November 12th and the following day, it is alleged that he entered a Second Street store, stole merchandise and left the store.  Police were contacted and an investigation resulted in the male facing 2 counts of Theft Under $5,000.00 and 2 counts of Breach of Probation.  He was held in custody until court later that day.

THEFT, MISCHIEF, USE OF CREDIT CARD and BREACH

Cornwall, Ont. – Nyle Adam Prairie, 23, of Cornwall was arrested on the 12th of December by the Ottawa Police Service on an unrelated matter and turned over to the Cornwall Police.  He was bound by a Probation Order with a condition to Keep the Peace and be of Good Behaviour.  It is alleged that on November 11th, he attended a Montreal Road learning facility and stole property from 2 lockers.  Police were contacted and an investigation resulted in determining that the victim’s credit cards were used to make purchases.  As a result of the investigation, the male faces 1 count of Mischief Under $5,000.00, 2 counts of Theft Under $5,000.00, 3 counts of Possession/Use of Credit Card and 1 count of Breach of Probation.  He was held in custody until court the following day.

MISCHIEF and BREACHES

Cornwall, Ont. – Lindsey Reanna Cole, 25, of Akwesasne turned herself into police on the 13th of December, 2010.  She was bound by a Recognizance Order with a condition to Keep the Peace and be of Good Behaviour.  She was further bound by a Conditional Sentence Order with the same condition and to abide by a curfew.  The female was also bound by a Probation Order with a condition to “Not commit any related or similar offence or any offence under a Statute of Canada or any province that is punishable by imprisonment.”  It is alleged that on October 31st, 2010 after curfew, the female attended a female’s residence and caused mischief to the front door of the apartment.  Police were contacted and an investigation was commenced.  As a result of the investigation, the female is facing 1 count each of Mischief Under $5,000.00, Breach of Recognizance, Breach of Probation and 2 counts of Breach of Conditional Sentence Order. She was held in custody until court the following day.

POSSESSION OF STOLEN PROPERTY

Cornwall, Ont. – Jamie Lloyd Whitebean, 53, of Cornwall was arrested on December 13th, 2010 following a shoplifting incident.  It is alleged that on that date, he stole property from a Water Street East department store.  He was arrested by the store’s Loss Prevention Officer and detained until the arrival of a member of the Cornwall Police Service.  He was processed under the “shoptheft” program. The man was located in possession of other stolen property from another store within the shopping mall.  As a result, the male is facing 1 count of Possession of Stolen Property.  He was released to appear in court at a later date to answer to the charge.

BREACH OF UNDERTAKING

Cornwall, Ont. – A 20 year-old Akwesasne male turned himself into police on the 13th of December, 2010 following an investigation.  The male was bound by an Undertaking Order with a condition to Keep the Peace and be of Good Behaviour and to not have any contact directly or indirectly with a specific female.  On the 01st of December, 2010, it is alleged that he was observed communicating with the female at a local restaurant.  Police were contacted and an investigation resulted in the male facing 2 counts of Breach of Undertaking.  The male was released to appear in court on the 30th of December, 2010 to answer to the charges.  His name is not being released as it may identify the victim in this incident.
