Toronto SIU Update on Sammy Yatim Shooter Constable James Forcillo to Surrender Tuesday Morning

forcillo fbCFN – Arrangements have been made through Constable James Forcillo’s lawyer, Peter Brauti, for his client to surrender himself into the custody of the Special Investigations Unit (SIU) tomorrow morning, Tuesday, August 20, 2013. Cst Forcillo will be transported to the Old City Hall and make an appearance before a Justice of the Peace shortly after the arrest.  Pursuant to the provisions of the Criminal Code, he will be detained in custody. The Criminal Code allows an accused to have the detention order reviewed in Superior Court and seek bail at any point in time.

Because Cst Forcillo has been the recipient of threats, we are not disclosing the location of the arrest.

Earlier today, SIU Director Ian Scott caused a charge of Second Degree Murder contrary to s. 235(1) of the Criminal Code to be laid against the officer in relation to the shooting death of 18-year-old Sammy Adib Yatim. The incident took place on a TTC streetcar around midnight on July 26-27, 2013.

The SIU is an arm’s length agency that investigates reports involving police where there has been death, serious injury or allegations of sexual assault. Under the Police Services Act, the Director of the SIU must

  • consider whether an officer has committed a criminal offence  in connection with the incident under investigation
  • depending on the evidence, lay a criminal charge against the officer if appropriate or close the file without any charges being laid
  • report the results of any investigations to the Attorney General.

  1. Dirty Harry Fuccillo the murderer. I was happy to read this earlier on yahoo’s news to see that he is going to be charged and I wish that it was first degree murder instead because it was murder in the first degree. The young man only had a knife and had a mental disorder and didn’t hurt or kill anyone and something different could have been used to take the young man down from doing any harm to anyone. I hope that this dirty cop rots I prison and that his soul is mighty troubled for the rest of his life. There is no greater law than God’s law and this dirty cop will burn in hell for sure. This dirty cop already took the mark of the beast.

  2. @ Jules. First degree murder is when it was pre-planned and thought out well before the killing. Second degree murder is the appropriate charge, and it has a chance of conviction.

  3. He’ll be out on bail the same day. They won’t find him guilty on that charge but may do so on a lesser charge.

  4. I hope that Dirty Harry rots in hell as well as in a prison cell and he should never be let loose on the streets. He is mighty dangerous to everyone – something is mighty wrong with his head. Furtz to me murder is murder and I don’t care if it was planned ahead or at the moment. This isn’t a human being but something of a very worst kind – most likely a serpent – son of Satan.

  5. @ Stan. Sadly, you are probably correct. He’s out on bail now. He’ll get off, but they’ll probably take his gun away.
    @ Jules. Son of Satan? More like a badly trained cop all pumped up on steroids. There are lots of them.
