Cornwall Ontario – While the Best Western Parkway Inn & Conference Centre & a few other parties to the Human Rights Tribunal complaint that’s reverberated across Canada have clarified or changed their policies to match the laws of the land, CFN confirmed that the City of Cornwall via it’s high priced Ottawa law firm ( are there really no lawyers good enough for the City locally?) had sent notice on June 30th that it would be defending the case which area legal minds have estimated at a cost of approximately $10K just to prepare for at current BLG rates.

Marie Pier Dupont of the Ottawa law firm of Caza Saikaley, who is representing the still unknown woman who filed the complaint, said that they were willing to remove parties from the complaint that simply agreed to follow the charter.

She confirmed the June 30th letter, and also confirmed that BLG had attempted to negotiate a solution, but that the law is pretty clear.  She confirmed that as of today the city has not changed it’s position.

Calypso Waterpark made a big media splash today by saying that it wouldn’t allow topless women.

At the root of the complaint is the simple practice of equality.  So for example, a business that has signs that state “no shirts, no service” is fine as long as it applies to both men and women?

A simple solution would simply adhering to the law as it stands, or even simply stating that anyone under 18 cannot be topless which would not be gender specific, but address the concerns of those that don’t want underage girls running around topless.

Great legal minds have suggested there’s slim legal glimmer for the defendant’s in trying to wangle section 20.3 of the Ontario Human Rights Code. 

But would a judge in Ontario really suggest a hotel, municipality, or water park was in fact a “recreational club”?

While businesses of course can choose to fight or not fight legal claims, the City of Cornwall is spending taxpayers money.  Is it really worth the fight over nipples??

This writer thinks it’d be great if the plaintiff and a crew of women appeared topless at City Council in Cornwall at the next meeting.  Of course I’m sure there are  are at least two councilors, alright three, or five,  that would think that’s a great idea too.

If NYC can have a Free the Nipple parade should Eastern Ontario really be covering up our women if our men can bare their boobs?  Methinks not. We should have more nipples freely wafting in the Summer breezes of our fair city in Lamoureux Park; especially this weekend!

I mean would you rather see Pastor Tom Newton and his signs in Lamoureux park or some women and men frolicking equally in the goose poop?

I can’t imagine former Mayor Bob Kilger spending city dollars to cover female boobs anywhere in Cornwall.

  1. This is beyond ridiculous. When is council and/or their lawyers going to realize that the law is quite clear? Women in Ontario can walk around topless, as can men. Besides the lawyer’s bill what is this going to cost us in fines, penalties, etc. It seems council has no common sense. At times it’s best to settle and save face than run up the lawyer’s bill just for a principle.

  2. Calypso could conceivably win since it is private property. The City of Cornwall is likely to lose since it is governed by self serving rogues and relics.

  3. There is no civilized country on earth where women walk bare chested at all. Women are very different biologically to men and a civilized man does not walk around on the streets bare chested at all. Cornwall is something else a place without any civilization and you might as well be in a jungle. Pastor Newton may give up trying to save souls because everything is going to hell.

  4. The only people winning in this is the complainant and lawyers. If “private” property owners weren’t concerned why has the Best Western already changed their policy. Whomever doesn’t update their policy and fights this will be paying dearly. The law is quite clear. Once again the screws will be put to the city taxpayers.

    Hugger to clarify the BW did not have a policy that violated the law according to the Hotel when I spoke with them.

  6. Well, I know one of the hotels mentioned in the OHRT complaint in Cornwall had said they updated their policy.

  7. Speaking about boobygate I roared with laughter at the noon hour when we came home. It is on yahoo.ca news and whoever it was talking about wanted their name to be concealed but I knew that part of it came from Cornwall – a great part. There was a mention about a woman in Guelph who took her top off and walked home and was arrested and I remember vaguely about this story. What a horrible societ

Unconfirmed reports out of City Hall indicate it will invoke the obscure “Blarney Defence” — Kringle v Point Pelee and Windsor Beach Club [1890] OJ No 196 (QL) (SCAM) — citing the bylaw subsection which states: “…and with respect to city operated swim, athletic, or sport facilities, and for purposes of sanitation, beverage containers must be covered at all times.”

  9. Cornwall made the National Post on Boobygate and this is going to be a huge laughter from coast to coast to coast. Cornwall always gets itself entagled into the most ridiculous idiocies on earth. I will be going down with my head mighty low as to be from that insane town. I hope that I don’t run into that teacher for quite a while because the laughter from him alone will sound out all over.

  10. She cherry picked her victims. While I agree with what she is doing picking litigants based on phone calls or emails and not denial of an actual right is stupid. This just furthers my belief that we are becoming like the U.S….lawsuit crazy. It has to stop

  11. There was something about girls riding bikes without a top on and that would cause mighty serious crashes and I would hate to see the insurance bills come in after that happening. Only the mighty insane lives in Cornwall. OMG what a disaster that this will inflict. It always takes some nutcase in Cornwall to start such a thing. The entire country knows all about Cornwalls insanity.
