Police to Enforce Orders under the Emergency Management and Civil Protection Act

On March 17, 2020, the government declared a provincial emergency through the authority granted under the Emergency Management and Civil Protection Act (EMCPA) and has enacted two Orders that will protect the public and reduce the harmful spread of COVID-19. The Cornwall Police Service (CPS) will be enforcing these two Orders in order to reduce the spread of the COVID-19 virus and better protect our community.

Based on expert advice received from the Chief Medical Officer of Health, the government will require the following establishments to be closed as of March 17th, 2020 until March 31st, 2020 unless the emergency is terminated earlier:


• All facilities providing indoor recreational programs,
• All public libraries,
• All private schools as defined in the Education Act,
• All licensed child care centres,
• All bars and restaurants, except to the extent that such facilities provide takeout food and delivery,
• All theatres including those offering live performances of music, dance, and other art forms, as well as cinemas that show movies, and
• All concert venues.

Additionally, based on advice received from Ontario’s Chief Medical Officer of Health, all organized public events of over fifty (50) people are hereby prohibited including parades and events and communal services within places of worship.

Any individual or corporation who fails to comply with the Orders identified above will be subject to an offence under Section 7.0.11(1) of the EMCPA for failing to comply with the Order or interfering or obstructing any person in the exercise of a power or the performance of a duty, conferred by an order under that subsection. Additionally, these individuals may be arrested in contravention of Section 129 of the Criminal Code for the obstruction of justice and liable to imprisonment for a term not exceeding two years.

Note that in any of these circumstances, under section 7.0.11(2), a person is guilty of a separate offence on each day that an offence under section 7.0.11(1) occurs or continues.

The Cornwall Police Service will be actively enforcing these Orders, and is reminding all individuals and businesses indicated within these Orders to cease operations immediately in the interest of public safety.

THEFT UNDER $5000, DANGEROUS OPERATION OF A MOTOR VEHICLE, FLIGHT FROM POLICE

Cornwall, ON – Michael Beauvais, 32, of Cornwall was arrested on March 16th, 2020 and charged with theft under $5000, flight from police, and dangerous operation of a motor vehicle. It is alleged on March 13th, the man attended a local pawn shop and removed merchandise, making no attempt to pay for the items as he left the store. It is further alleged on March 16th, the man was operating a motor vehicle in a dangerous manner in the area of McConnell Avenue and Second Street and failed to stop for police. An investigation ensued and the man was taken into custody. He was charged accordingly and released to appear in court on April 23rd, 2020.

BREACH

Cornwall, ON – A 21-year-old Cornwall woman was arrested on March 16th, 2020 and charged with five counts of breach of probation for contacting her boyfriend, being within 20 metres of him, and failing to keep the peace. She was also charged with breach of recognizance for failing to keep the peace. It is alleged while investigating an unwanted person complaint on March 16th, the woman was located at her boyfriend’s residence, despite her conditions. During the investigation, she was taken into custody, charged accordingly and held for a bail hearing. Her name was not released as it would identify the victim in the matter.

DOMESTIC ASSAULT

Cornwall, ON – A 33-year-old Cornwall man was arrested on March 16th, 2020 and charged with domestic assault. It is alleged during an altercation with his common-law-wife, the man assaulted her and police were contacted to investigate. During the investigation, he was taken into custody, charged accordingly and released to appear in court on June 9th, 2020. His name was not released as it would identify the victim in the matter.

CALLS FOR SERVICE

There were 58 calls for service in the City of Cornwall over the last 24 hours (8:00 am yesterday to 8:00 am today).
