Traveller convicted for failing to report to Cornwall port of entry

An Akwesasne, Ontario resident was convicted of failing to report to the Cornwall port of entry (POE), the Canada Border Services Agency (CBSA) announced today.
On June 5, 2017, 36-year-old Windell King, driving northbound, approached the bridge toll booth before the Cornwall POE, but drove through going the wrong way using the southbound lane. He bypassed the Cornwall POE entirely and did not report to the CBSA. King was later arrested by Cornwall Community Police Services.
King was charged with evading compliance under section 153 (c) of the Customs Act and subsequently sentenced on July 20, 2017 to 45 days pre-trial custody and a four-month conditional sentence.

Based on this information, from CBSA that any individual that enters Canada and does not report to CBSA POE, is subject to prosection, are we to understand that all of those folks in tent cities in Cornwall as well as those in the Big O in Montreal will be prosecuted? And since they will then all have criminal records, will that then make them ineligible for refugee Status?
